Welcome to Himalayan Signature. These Terms and Conditions govern the use of our website and the booking of our travel, trekking, tour, expedition, transportation, accommodation, and related services. By making a booking with Himalayan Signature, you acknowledge that you have read, understood, and agreed to these terms.
Booking and Confirmation
All bookings are subject to availability and are confirmed only after Himalayan Signature receives the required booking information and payment or deposit.
The person making the booking is responsible for providing accurate information, including names, passport details, travel dates, nationality, emergency contacts, and other information required for the trip.
A booking confirmation or payment receipt issued by Himalayan Signature serves as confirmation of the agreed travel arrangements.2. Payments
A deposit may be required to confirm a booking. The remaining balance must be paid within the period specified in the booking confirmation.
Certain services, including peak-season tours, expeditions, flights, permits, luxury accommodations, or specially arranged services, may require different payment schedules.
If the required payment is not received by the stated deadline, Himalayan Signature reserves the right to cancel the booking and apply the applicable cancellation charges.
Prices and Inclusions
The price of each package is based on the services specifically mentioned in the relevant itinerary or quotation.
Inclusions may include accommodation, meals, transportation, guides, permits, entrance fees, domestic flights, or other services depending on the selected package.
Unless specifically stated, personal expenses, international airfare, travel insurance, visa fees, alcoholic beverages, laundry, tips, emergency evacuation, medical expenses, and other personal costs are not included.
Prices may change due to government regulations, permit fees, transportation costs, accommodation rates, taxes, fuel prices, exchange-rate fluctuations, or other circumstances beyond our control. Any applicable changes will be communicated to the client where reasonably possible.
Travel Documents and Permits
Clients are responsible for ensuring that they have valid passports, visas, travel insurance, permits, vaccination documents where applicable, and other required travel documents.
Passport information provided to Himalayan Signature must be accurate. Himalayan Signature is not responsible for losses, delays, denied boarding, or other problems resulting from incorrect or incomplete information supplied by the client.
For trekking and expedition packages, required permits and official documentation will be arranged according to the services included in the package.
Cancellation by the Client
Cancellation requests must be submitted to Himalayan Signature in writing.
Cancellation charges may apply depending on the date of cancellation and the services already booked or paid for on the client's behalf. Certain costs, such as airline tickets, permits, hotel reservations, transportation, expedition arrangements, and other third-party services, may be non-refundable.
The exact refund applicable to a cancelled booking will depend on the cancellation policy specified in the booking confirmation or package quotation.
Cancellation or Changes by Himalayan Signature
Himalayan Signature reserves the right to modify, postpone, or cancel a trip when necessary due to circumstances including natural disasters, extreme weather, political unrest, strikes, road or airport closures, government restrictions, safety concerns, health emergencies, or other circumstances beyond our reasonable control.
Where possible, we will offer a suitable alternative, revised itinerary, or rescheduling option.
If a service becomes unavailable due to circumstances beyond our control, Himalayan Signature may arrange a reasonable alternative of similar value where possible.
Itinerary Changes
Travel itineraries are planned carefully but may need to be changed due to weather, road conditions, flight schedules, local conditions, availability, safety considerations, government regulations, or other unforeseen circumstances.
For trekking and mountaineering programs, the itinerary may be adjusted based on the group's health, weather, trail conditions, acclimatization requirements, or the professional judgment of the guide or expedition leader.
Such changes do not automatically entitle the client to a refund.
Flights and Transportation
Domestic flights in Nepal and other transportation services are subject to airline and transportation-provider schedules and operating conditions.
Flight delays, cancellations, baggage issues, road closures, traffic, weather, and other transportation-related disruptions may occur. Himalayan Signature will assist clients in finding reasonable alternatives where possible but cannot guarantee the operation of services controlled by third-party providers.
Additional costs resulting from delays or changes caused by circumstances beyond Himalayan Signature's control may be payable by the client.
Trekking, Adventure and Expedition Activities
Trekking, mountaineering, hiking, rafting, wildlife activities, and other adventure programs involve inherent risks, including altitude-related problems, extreme weather, accidents, injury, illness, difficult terrain, natural disasters, and delays.
Clients must follow the instructions of their guides, expedition leaders, and other authorized personnel.
Himalayan Signature reserves the right to modify or terminate a trip if a guide or responsible trip leader determines that continuing would create an unreasonable risk to the client or group.
Health and Fitness
Clients are responsible for ensuring that they are physically and mentally fit for their selected trip.
Clients should inform Himalayan Signature of any relevant limitations or requirements that may affect their ability to participate safely. For high-altitude trekking and expeditions, clients should obtain appropriate medical advice before travelling.
If a client becomes ill or is unable to continue a trip, Himalayan Signature will provide reasonable assistance where possible. Any medical treatment, evacuation, additional accommodation, transportation, or other resulting expenses are the responsibility of the client unless covered by insurance.
Travel Insurance
Comprehensive travel insurance is strongly recommended and may be required for certain trekking and expedition packages.
Insurance should provide appropriate coverage for trip cancellation, medical treatment, accidents, baggage loss, emergency evacuation, helicopter rescue, and high-altitude trekking or mountaineering where applicable.
Himalayan Signature is not responsible for expenses that could reasonably have been covered by appropriate travel insurance.
Accommodation
Accommodation is provided according to the category specified in the selected package.
Room types, hotel availability, facilities, and services may vary depending on location and season. In remote trekking areas, accommodation may be basic and different from standard city hotels.
Where the specified accommodation becomes unavailable, Himalayan Signature may arrange an alternative of a similar standard whenever reasonably possible.
Personal Belongings
Clients are responsible for their passports, money, electronic devices, luggage, valuables, and personal belongings throughout the trip.
Himalayan Signature is not responsible for loss, theft, or damage to personal property unless directly caused by our proven negligence.
Clients are advised to use hotel safes or other secure storage facilities where available.
Guides, Porters and Staff
Our guides, porters, drivers, and other staff are expected to provide professional and respectful service.
Clients are expected to treat all staff members respectfully and follow reasonable instructions relating to safety and the smooth operation of the trip.
Any serious misconduct, harassment, abusive behavior, illegal activity, or behavior that endangers other travelers or staff may result in removal from the trip without refund.
Responsible and Sustainable Travel
Himalayan Signature encourages responsible tourism and asks all travelers to respect local communities, cultures, traditions, wildlife, religious sites, and the natural environment.
Clients must follow local regulations and avoid activities that may damage the environment or disrespect local customs.
Photography and Promotional Use
With the client's permission, Himalayan Signature may use photographs or videos taken during trips for promotional, marketing, website, or social media purposes.
Clients who do not wish to appear in promotional materials may inform Himalayan Signature in advance or at any reasonable time during the trip.
Complaints
If a client experiences a problem during a trip, the issue should be reported to the guide, trip leader, or Himalayan Signature representative as soon as possible so that we have a reasonable opportunity to resolve it.
Complaints submitted after the completion of the trip should be made in writing within a reasonable period and should include relevant details and supporting documents where applicable.
Third-Party Services
Himalayan Signature may work with airlines, hotels, transportation companies, local guides, restaurants, activity providers, and other third-party suppliers.
While we carefully select our service partners, Himalayan Signature cannot be held responsible for circumstances arising solely from the actions, omissions, delays, cancellations, or service failures of independent third-party providers, except where applicable law provides otherwise.
Website Information
Himalayan Signature makes reasonable efforts to ensure that information published on its website is accurate and up to date. However, itineraries, prices, schedules, photographs, accommodation, transportation, and other details may change without prior notice.
Website content is provided for general information and does not replace the specific terms contained in a client's booking confirmation or written quotation.
Privacy
Personal information collected during the booking process will be handled in accordance with Himalayan Signature's Privacy Policy. Information may be shared with relevant service providers when necessary to arrange the services included in a booking.
Limitation of Liability
To the extent permitted by applicable law, Himalayan Signature shall not be liable for indirect, incidental, consequential, or additional losses arising from circumstances beyond our reasonable control.
Nothing in these Terms and Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
Governing Law
These Terms and Conditions shall be governed by the applicable laws of Nepal. Any disputes arising in connection with our services will, where necessary, be subject to the jurisdiction of the appropriate courts or legal authorities of Nepal.
Acceptance of Terms
By submitting a booking request, making a payment, or participating in a Himalayan Signature trip, the client confirms that they have read, understood, and accepted these Terms and Conditions.
Himalayan Signature reserves the right to update these Terms and Conditions when necessary. The latest version published on our website will apply to future bookings.
